Case Study: Inclusive Cmtys. Project, Inc. v. Heartland Cmty. Ass'n



This case study follows the analysis of a disparate treatment and disparate impact in housing claim. A homeowners association had prohibited certain would-be residents, including recipients of Section 8 housing assistance. Plaintiffs alleged disparate impact and disparate treatment claims, claiming that these policies were enacted for purposes of discriminating against racial minorities and that they had the impact of discriminating against racial minorities. The court had to analyze whether the elements of each applied.
