Case Study: Estate of Kam
This case study analyzes a tangled and messy, wherein siblings fell out and, after their father's' death, fought over his estate. It was a classic case of the doing of a new will by an elderly parent. Allegations of bad faith, undue influence and in proper execution of the new will flew all over the place. The court had to analyze the elements of will execution and undue influence carefully in light of the circumstances and the allegations. This case study methodically works through the analyses and the results.
