Case Study: Crawford v. Tribeca Lending Corp.



This case study looks at the Second Circuit's analysis of several issues covered by the Evidence course. In a mortgage fraud lawsuit, one question arose as to whether the practice of the company rose to the level of "habit, routine or practice" to avoid being inadmissible character evidence. The admissibility of photocopies of loan documents was analyzed both under the hearsay rule and under the original documents rule. The court also discussed the standards for authentication of copies. This case study illustrates the case and described the court's approach on each issue.
