Case Study: Aurzadniczek v Humana



This case study looks at a lawsuit over a denial of health insurance claim made for cancer treatments. The insurance company claimed that some of the treatments were made before the policy "effective" date and the rest were based on a pre-existing condition that arose before the effective date. The plaintiff presented a myriad of claims, including breach of contract, bad faith and fraud. This case study analyzes how all those claims were handled by the court.
