Case Study: Pogue v. Northwestern Mut. Life Ins. Co.
This case looks at the discovery process that got nasty. When a video deposition of Northwest Mutual designees dragged on to the point that it ended before the plaintiff that all the information and wanted, the plaintiff requested that another deposition be ordered. The plaintiff accused the Northwest Mutual representatives of being underprepared and it's lawyer of stonewalling, while Northwest Mutual accused the plaintiff of wasting time on irrelevancies and subject matter that was beyond the scope of the deposition's purpose. The court had to step in and referee the dispute, carefully analyzing which party was at fault for the botched deposition and what to do about it.
