Case Study: Hugo Boss Retail v. A/R Retail



This case study examines the impact of the COVID-19 pandemic on commercial retail lease agreements. As happened to so many stores around the country, the Hugo Boss location at a popular and very expensive Manhattan location suffered greatly due to the COVID-19 restrictions imposed by city and state regulations. The question this court had to grapple with is whether and to what extent the purpose of such lease agreements is frustrated when commercial stores could not be used to their full potential during the pandemic. General principles of law as well as interpretations of the provisions in the applicable lease agreement are examined in detail in this important case.
