Case Study: Homaidan v. Sallie Mae
This case study deals with the circumstances under which student "loans" can be discharged in Bankruptcy in spite of the general rule that student loan debt is not dischargeable. A major component of the case is exactly what sort of arrangement is considered a student loan. The presentation also focuses on procedural aspects of the litigation and the rules of statutory interpretation applied by the court.
