Case Study: Health Freedom Defense Fund v. President Biden
In April 2022, a federal judge in Florida declared the public transportation mask mandate unconstitutional. The mandate had been in effect since 2020 due to the COVID-19 pandemic. On advice from the CDC, the Biden administration elected to appeal the decision. However, it did not request a stay of the order pending the appeal, which would have reimposed the mask mandate. In this case study, we look at the decision and discuss the administrative law and even political ramifications of the decision and the important questions of administrative law that hinge on government's appeal.
