Case Study: Bennett v Broderick



This case study looks at two disparate aspects of checks. First, does writing a check for a down payment and the first month of lease constitute valid acceptance of the lease terms? What if the check is postdated? Can the check be rejected merely for that reason? Second, what responsibilities and discretions does a bank have in determining whether to honor a check? Can a bank choose to honor a check even before its date? This case study focuses on contract law and the UCC provisions that govern checks and other negotiable instruments.
