Case Study: Allied Debt Collection of Va., L.L.C. v. Nautica Entm't, L.L.C.



This case study looked at a strongly contested e-discovery dispute. To verify the accuracy of content orders to be turned over, the Ohio trial court compelled a process called "forensic imaging" to ensure the accuracy of the electronically stored information turned over during the e-discovery process. The appellate court had to analyze not only whether the step was appropriate, but also the responsibility of trial courts to balance the need for accurate discovery information against the right of each litigant to keep much of its information private.
